Welcome to ScanJunk! These Terms of Service ("Terms") govern your use of the ScanJunk mobile application and junk removal services (collectively, the "Services") operated by ScanJunk Removal Services LLC. By accessing or using our Services, you agree to be bound by these Terms.

Important: Please read these Terms carefully before using our Services. If you do not agree to these Terms, you may not use our Services.

Who Can Use Our Services:

  • You must be at least 18 years old
  • You must have legal capacity to enter into binding contracts
  • You must provide accurate and complete information
  • You must comply with all applicable laws and regulations

Electronic Acceptance:

By clicking "I Accept," creating an account, or using our Services, you acknowledge that:

  • You have read and understood these Terms
  • You agree to be legally bound by these Terms
  • Electronic acceptance constitutes your legal signature
  • You consent to conduct transactions electronically

How It Works:

  1. Provide details about your junk removal needs
  2. Receive a service estimate
  3. Schedule a pickup time and location
  4. Pay securely via Stripe
  5. Our team picks up and disposes of items responsibly

Account Registration and Security

Creating an Account

Required Information:

  • Full name
  • Phone number
  • Email address (optional via Apple Sign In)
  • Valid payment method

Account Requirements:

  • Provide accurate, current, and complete information
  • Update information promptly if it changes
  • One account per person (no duplicate accounts)
  • You are responsible for all activity under your account

Account Security

Your Responsibility:

  • Keep your password confidential and secure
  • Do not share your account credentials with others
  • Notify us immediately of any unauthorized access
  • Use strong, unique passwords
  • Enable two-factor authentication when available

We May Suspend or Terminate Your Account If:

  • You violate these Terms
  • You provide false or misleading information
  • You engage in fraudulent activity
  • You abuse or harass our staff or other users
  • You use the service for illegal purposes
  • Your account remains inactive for an extended period

SMS Consent and Notifications

By providing your phone number through the ScanJunk mobile app, you consent to receive text messages from ScanJunk Removal Services LLC. These messages may include verification codes, booking confirmations, and service updates related to your junk removal requests. Message and data rates may apply depending on your mobile carrier.

You may opt out of receiving text messages at any time by replying STOP to any message you receive from us. For help, you may reply HELP or contact us at [email protected].

We do not use SMS messages for marketing or promotional purposes. All text messages are strictly transactional and related to your requested services.

Booking and Service Terms

Scheduling Pickups

Booking Process:

  • Select pickup date and time slot
  • Provide accurate address and access instructions
  • Describe items for removal
  • Review and confirm pricing estimate
  • Authorize payment method

Changes and Cancellations:

  • Cancel or reschedule up to 24 hours before scheduled pickup at no charge
  • Cancellations within 24 hours may incur a cancellation fee of up to 50% of the estimated cost
  • We may cancel or reschedule due to weather, emergencies, or operational needs (full refund provided)
  • No-show without cancellation: full charge applies

Pricing and Payment

Pricing:

  • Estimates are approximate, not guaranteed
  • Final price determined on-site based on actual volume, weight, and accessibility
  • Final price will not exceed estimate by more than 20% without your express approval
  • All prices in United States Dollars (USD)
  • Prices include pickup, labor, disposal, and applicable fees
  • Taxes included in final price as required by law

Additional Charges May Apply For:

  • Hazardous materials requiring special disposal (if accepted)
  • Items requiring multiple personnel (over 100 lbs)
  • Difficult access (stairs beyond first floor, long walks over 50 feet)
  • Additional items not disclosed in original booking
  • Special handling or disassembly requirements

Payment:

  • Payment processed via Stripe (secure, PCI DSS compliant payment gateway)
  • Payment method authorized upon booking confirmation
  • Charged after successful pickup completion
  • You authorize us to charge the payment method on file for services rendered
  • Refunds processed for cancelled pickups (see Refund Policy below)

Payment Failure:

  • If payment fails, we will attempt to retry within 24 hours
  • We will notify you via email/SMS of payment failures
  • Service may be suspended until payment is resolved
  • Repeated payment failures may result in account suspension

  • Carpets and rugs

❌ Not Accepted

  • Hazardous materials (paint, chemicals, solvents)
  • Medical waste or biohazards
  • Biological waste
  • Firearms, ammunition, or explosives
  • Illegal substances or contraband
  • Radioactive materials
  • Asbestos or materials containing asbestos
  • Items requiring special permits

Pickup Times:

  • Same-day pickup (subject to availability)
  • Next-day pickup
  • Scheduled pickup (up to 14 days in advance)
  • Operating hours: Monday-Saturday, 8 AM - 6 PM Pacific Time
  • Limited Sunday availability in some areas
  • Holiday schedules may vary

User Conduct and Responsibilities

Prohibited Uses

You agree NOT to:

  • Create multiple accounts or use another person's account without permission
  • Book services with no intention to use them (fraudulent bookings)
  • Provide false, misleading, or offensive information
  • Attempt to hack, reverse engineer, or exploit our systems
  • Use our services for illegal purposes or to facilitate illegal activities
  • Harass, threaten, or abuse our staff or other users
  • Submit false information or impersonate others
  • Interfere with the proper functioning of the Services

Access Requirements

For Pickup:

  • Ensure safe, clear access to items to be removed
  • Provide accurate access instructions (gate codes, parking, etc.)
  • Be available or designate someone during the 2-hour pickup window
  • Ensure pets are secured and cannot interfere with service
  • Clear pathways to items (minimum 3-foot clearance)
  • Notify us of any special conditions (fragile items nearby, security systems, etc.)

Property Damage:

  • We take reasonable care to avoid property damage during service
  • You must disclose any special conditions that could lead to damage
  • Report any damage claims within 24 hours via email with photos
  • ScanJunk Removal Services LLC is fully insured with general liability coverage
  • Claims investigated and responded to within 5 business days

Service Estimation and Pricing

How Estimates Work:

  • You provide information about items for removal via the app
  • Pricing estimate is generated based on submitted information
  • Our team reviews and confirms estimates
  • Final pricing is determined on-site

Important: Estimates are approximate, not guaranteed. Actual pricing is determined on-site by our team based on the actual volume, condition, and accessibility of items.

Intellectual Property Rights

Our Intellectual Property

  • ScanJunk name, logo, trademarks, and service marks are our property
  • App design, user interface, and features are our intellectual property
  • Algorithms, pricing models, and proprietary technology are protected
  • Content, text, graphics, and images are owned by us or licensed to us
  • Unauthorized use, reproduction, or distribution is prohibited

Your Content

  • You retain ownership of content you provide
  • You grant us a limited, non-exclusive license to use information you provide for service delivery
  • You represent that you have the right to share the information you provide

Payment Terms and Refunds

Refund Processing:

  • Refunds processed within 5-7 business days
  • Refunded to original payment method via Stripe
  • Stripe processing fees (typically 2.9% + $0.30) are non-refundable
  • Bank processing time may vary (3-10 business days)

Chargebacks:

  • Please contact us before filing a chargeback with your bank
  • Unauthorized chargebacks may result in account suspension
  • We reserve the right to contest invalid chargebacks
  • Chargeback fees ($15-25) may be passed to customer if dispute is found invalid

Disclaimers and Warranties

DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • The Services will be uninterrupted, timely, secure, or error-free
  • Estimates will be 100% accurate
  • All junk items can or will be removed
  • The Services will meet your specific requirements
  • Any errors or defects will be corrected
  • The Services are free from viruses or harmful components

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We are NOT liable for indirect, incidental, special, consequential, or punitive damages
  • Our total liability is limited to the amount you paid for the specific service (not to exceed $500)
  • This applies to all claims arising from or related to our Services
  • Includes but not limited to: lost profits, data loss, business interruption, personal injury (except gross negligence), property damage (except as covered by insurance)

Some jurisdictions do not allow limitation of liability for personal injury or incidental/consequential damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

Damages and Injury

Property Damage:

  • ScanJunk Removal Services LLC is fully insured with general liability coverage
  • Report damage within 24 hours to [email protected]
  • Provide photos and detailed description
  • We will investigate and respond within 5 business days
  • Valid claims subject to insurance coverage limits and deductibles

Indemnification

You agree to indemnify, defend, and hold harmless ScanJunk Removal Services LLC, its officers, directors, employees, contractors, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

  • Your use or misuse of the Services
  • Your violation of these Terms
  • Your violation of any third-party rights (including intellectual property or privacy rights)
  • Your violation of any applicable laws or regulations
  • Content or information you submit
  • Fraudulent or illegal activity

Force Majeure

We are not liable for failure to perform Services due to circumstances beyond our reasonable control, including but not limited to:

  • Acts of God (earthquakes, floods, fires, storms)
  • Natural disasters
  • War, terrorism, or civil unrest
  • Pandemic, epidemic, or public health emergency
  • Government restrictions or orders
  • Strikes or labor disputes
  • Utility failures or infrastructure outages
  • Supply chain disruptions

In such events, we will make reasonable efforts to notify you and reschedule service when possible.

Most disputes can be resolved informally. We encourage you to contact us first before pursuing arbitration or legal action.

Arbitration Agreement

Binding Arbitration:

  • Disputes not resolved informally will be resolved through binding arbitration
  • Arbitration conducted under American Arbitration Association (AAA) Consumer Arbitration Rules
  • Arbitration on an individual basis only (no class actions - see below)
  • Arbitration conducted in Stockton, California or remotely via video conference
  • Arbitrator's decision is final and binding
  • Judgment may be entered in any court of competent jurisdiction

Exceptions to Arbitration:

  • Small claims court (for claims under $10,000)
  • Intellectual property disputes
  • Injunctive relief for Terms violations
  • Claims that cannot be arbitrated by law

Class Action Waiver:

You agree to resolve disputes on an individual basis only. NO CLASS ACTIONS, CLASS ARBITRATIONS, OR REPRESENTATIVE ACTIONS are permitted.

Opt-Out: You may opt out of this class action waiver within 30 days of account creation by emailing [email protected] with "Class Action Waiver Opt-Out" in the subject line.

Governing Law and Jurisdiction

Governing Law:

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Jurisdiction and Venue:

Any legal action or proceeding relating to your access to or use of the Services (where arbitration does not apply) shall be instituted in a state or federal court in San Joaquin County, California. You agree to submit to the jurisdiction of such courts and waive any objection to venue.

Updates to Terms

We May Update These Terms:

  • To reflect changes in our Services or business practices
  • To comply with legal, regulatory, or security requirements
  • To improve clarity or address issues
  • To add new features or remove discontinued features

Notice of Changes:

  • "Last Updated" date will be revised at the top of this page
  • Material changes will be notified via in-app notification or email
  • You will have 30 days to review material changes before they take effect
  • Continued use after changes take effect constitutes acceptance
  • If you don't agree to changes, you must stop using the Services and may request account deletion

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ScanJunk Removal Services LLC regarding the Services and supersede all prior agreements, understandings, and communications, whether written or oral.

Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.

Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

Assignment

We may assign or transfer these Terms and our rights and obligations to another company (e.g., in case of merger, acquisition, sale of assets, or by operation of law). You may not assign your rights under these Terms without our prior written consent.

Relationship of Parties

Nothing in these Terms creates a partnership, joint venture, employment, franchise, or agency relationship between you and ScanJunk Removal Services LLC. You have no authority to bind us or make commitments on our behalf.

Survival

The following sections survive termination of these Terms: Intellectual Property Rights, Disclaimers and Warranties, Limitation of Liability, Indemnification, Dispute Resolution, Governing Law, and General Provisions.
